Right of withdrawal

The Buyer can exercise the right of withdrawal and return the goods within 14 calendar days of receipt of the goods in their ownership by sending the Seller a letter of withdrawal to detales@e-autex.lt. At the Buyer’s request, the Seller shall send the letter of withdrawal form to the Buyer by e-mail.

The right of withdrawal will expire in 14 days starting from the day, when the Buyer or the third party specified by the Buyer, which is not the shipper, has received the goods in their possession. To avoid misunderstanding, at the time of receiving the goods it is necessary to ascertain whether they correspond to those ordered – manufacturer, model, colour, size and other significant parameters.

If the Buyer refuses the order or part thereof Autex Lietuva UAB will refund the value of the goods in full according to the specific distance contract amount. Autex Lietuva UAB reserves the right not to pay any transportation costs and other costs related to assembling or delivery of the goods.

Money shall be refunded not later than within 14 calendar days of the day, when Autex Lietuva UAB has received the goods refused by the Buyer, unless the Buyer cannot exercise the right of withdrawal.

When shipping the goods, the Buyer shall ensure that they are packaged in such a way that the goods cannot be damaged during transport. It is recommended to assess whether the goods to be returned should be insured, otherwise the Buyer will be liable for damage to the goods.

If the Buyer wishes to exercise the right of withdrawal, it should be borne in mind that the Buyer shall be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. It should therefore be borne in mind that, during the period of exercising the right of withdrawal, the Buyer has the right to use the goods to the extent necessary for the examination of the goods (as much as you could do before buying the goods in a regular store). When exercising the right of withdrawal, the Buyer shall be responsible for the use of the goods exceeding what is necessary for the examination of the goods, for such use of the goods throughout the withdrawal period, which is not compatible with the principle of good faith, as well as for diminished value, quality and safety of the goods.

 

When the Buyer cannot exercise the right of withdrawal

  • The Buyer may not exercise the right of withdrawal if:
    • the goods ordered cannot be returned due to their nature;
    • the goods ordered have been produced specifically for the Buyer based on an individual order or personalised;
    • the Buyer has deliberately damaged the goods or their packages.
      Section 12(6) of the Consumer Rights Protection Law of the Republic of Latvia provides that “the consumer shall be liable for preservation of the quality and safety of the goods throughout the withdrawal period”. The Seller reserves the right to refuse the right of withdrawal to the Buyer or keep a compensation fee if the goods have been damaged due to negligent treatment during use or not following the instructions, if the original packaging of the goods has been lost or significantly damaged.


Dispute settlement

Please submit any complaint regarding the availability or quality of goods electronically by sending it to the e-mail address detales@e-autex.lt.

The complaint will be examined within 7 working days of its receipt.

If the complaint is found to be unfounded and you do not agree to the recognition of the complaint as unfounded, you have the right to use the alternative dispute resolution possibilities specified in regulatory enactments by submitting a written application to the Seller of the goods regarding an out-of-court resolution of the dispute, specifying:

  • name, surname, contact details;
  • date of submission of the application;
  • nature of the dispute, claim and substantiation thereof.

Warranty conditions

The terms of the manufacturer’s warranty are valid if the Buyer can present

  • proof of purchase (cheque, delivery note or receipt);
  • manufacturer’s or distributor’s warranty card, serial number (if the manufacturer or distributor has included one with the goods).


    Manufacturer’s warranty 

    The warranty terms do not apply to:

    • Customers’ own labour costs, travel and accommodation expenses;
    • the costs of delivery or transport;
    • normal wearable parts such as filters, gaskets, bearings, hoses, belts, chains, saw rails, sensors, bulbs, fuses, oils, knife blades on pruning equipment, etc.;
    • injectors and ID modules;
    • defects caused by normal wear and tear.
